This calculator is intended solely for help in determining the latest date by when a public body must respond to an access to information or correction of personal information request.

This calculator is a guide only. A public body may provide its response outside of the date provided by this calculator if it obtained permission for a time extension from this Office. If this occurs, the public body will provide you with the revised response date in writing. Additionally, this calculator presumes that there is no delay between the date on which you submit your request and the date on which it is received by the public body. If, however, you chose to mail your request to the public body, there may be a delay between the date on which you submit your request and its receipt by the public body, and the date this calculator provides may be inaccurate as a result. There may also be other permitted reasons for a delay in receipt. Public bodies must base their calculations of the number of business days for response on the actual date it receives a request.

Public bodies should respond to requests as soon as possible. Consequently, you may also receive a response sooner than this calculator indicates.

Public bodies are required to provide an advisory response to applicants within ten business days of receiving a request.

Public bodies are required to provide a final response to a request in writing within 20 business days of receiving it unless they have obtained a time extension from this Office.

If you made your access to information or correction of personal information request to a municipality, please be advised that this calculator does not consider recognized civic holidays, with the exception of Regatta Day, in its calculations. Therefore, if you believe your response may be due on or near a recognized civic holiday, you should contact the municipality to which you made your request or this Office to obtain your response date. Additionally, while this calculator does consider Regatta Day in its calculations, this date is ultimately determined in a customary manner and is subject to change.

The following days are not included in the calculation of business days:

  1. Saturdays;
  2. Sundays;
  3. New Years Day;
  4. Good Friday;
  5. Victoria Day;
  6. Canada Day;
  7. Regatta Day/Civic Holidays;
  8. Labour Day;
  9. Thanksgiving Day;
  10. Remembrance Day;
  11. Christmas Day; and
  12. Boxing Day.

You may not rely upon the dates that this calculator provides to calculate review or appeal periods. You must use the actual date on which you receive the response from the public body to work out your time limit for requesting a review by the Commissioner or filing an appeal with the Supreme Court of Newfoundland and Labrador.
